Terms of Service

1. Acceptance of Terms

By accessing or using Spritely ("the Service"), operated by Red Road Studio, LLC ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Spritely is an AI-powered tool that generates sprite sheets for game development. The Service uses third-party AI models to generate images based on text prompts.

3. User Accounts

You must be at least 13 years old to use the Service. To use certain features, you must create an account. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, or violates third-party rights
  • Attempt to circumvent usage limits or billing
  • Reverse engineer or exploit the Service
  • Interfere with other users' access to the Service
  • Generate content depicting real individuals without consent

5. API and Programmatic Access

If you use API keys to access the Service programmatically:

  • API keys are issued per-account and you are responsible for keeping them secure
  • We may revoke API keys at any time for abuse or violation of these terms
  • Automated and programmatic access is subject to the same terms as web usage
  • Rate limits may apply and may be adjusted at our discretion

6. Intellectual Property

Your Content

You retain ownership of the prompts you submit. Generated images are provided under the terms of the underlying AI model providers. Generally, you may use generated images for personal and commercial purposes, subject to those providers' terms.

Our Content

The Service, including its design, code, and documentation, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our proprietary content without permission.

7. Pricing and Payment

The Service offers monthly subscriptions and a one-time lifetime access purchase. Current prices are shown on the pricing page. Free accounts receive a limited number of sprite generations per day, subject to an overall free-tier cap. Daily limits reset at midnight UTC.

API usage costs are deducted from a prepaid balance on your account. You can add funds to your balance at any time. All fees are non-refundable except where required by law or at our sole discretion.

We reserve the right to change pricing with reasonable notice. Continued use after a price change constitutes acceptance.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • The quality, accuracy, or suitability of generated content
  • That the Service will meet your specific requirements
  • That generated content will be free from errors or artifacts

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Red Road Studio and its operators from any claims arising from your use of the Service or violation of these terms.

12. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time.

13. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.
