Terms of Service

1. Acceptance of Terms

By accessing or using Spritely ("the Service"), operated by Red Road Studio, LLC ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Spritely is an AI-powered tool that generates sprite sheets for game development. The Service uses third-party AI models to generate images based on text prompts.

3. User Accounts & Eligibility

You must be at least 13 years old to use the Service. If you are in the European Union, the United Kingdom, or another jurisdiction that sets a higher digital age of consent, you must be at least 16 years old, or have verifiable consent from a parent or legal guardian, to use the Service. By using the Service you represent that you meet these requirements.

To use certain features, you must create an account. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, or violates third-party rights
  • Attempt to circumvent usage limits or billing
  • Reverse engineer or exploit the Service
  • Interfere with other users' access to the Service
  • Generate content depicting real individuals without consent

5. API and Programmatic Access

If you use API keys to access the Service programmatically:

  • API keys are issued per-account and you are responsible for keeping them secure
  • We may revoke API keys at any time for abuse or violation of these terms
  • Automated and programmatic access is subject to the same terms as web usage
  • Rate limits may apply and may be adjusted at our discretion

6. Intellectual Property

Your Content

You retain ownership of the prompts you submit. As between you and us, we claim no ownership of the sprite sheets and images the Service generates for you, and you may use them for personal and commercial purposes. This right is subject to (a) your compliance with these Terms, and (b) the license terms of the AI models used to generate the output, described below.

AI Model Licenses

The Service generates images using several AI models, each governed by its own license. Your use of the generated output must comply with the license of the model that produced it:

  • Some styles are produced by models released under permissive open-source licenses (such as Apache 2.0), which place minimal restrictions on the resulting images.
  • Other styles are produced by models released under a Responsible AI License (OpenRAIL-family). These licenses permit commercial use but impose use-based restrictions — for example, you may not use the model or its outputs to generate unlawful content, to harass, defame, or discriminate against individuals or groups, to produce sexual content involving minors, or for other prohibited purposes set out in the license. These restrictions pass through to you as the end user and survive any transfer of the output.

You are responsible for reviewing and complying with the applicable model license. We may identify the model or license associated with a given style on request. You agree not to use generated output in any way prohibited by the applicable license.

AI-Generated Content and Copyright

Images produced by the Service are generated by artificial intelligence. In some jurisdictions, including the United States, works that lack sufficient human authorship may not be eligible for copyright protection, in whole or in part. We make no representation that any generated output is protectable by copyright or is free of third-party rights, and you are solely responsible for clearing any rights necessary for your intended use.

Our Content

The Service, including its design, code, and documentation, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our proprietary content without permission.

7. Pricing and Payment

The Service offers monthly subscriptions and a one-time Full Access purchase. Current prices are shown on the pricing page. Free accounts receive a limited number of sprite generations per day, subject to an overall free-tier cap. Daily limits reset at midnight UTC.

API usage costs are deducted from a prepaid balance on your account. You can add funds to your balance at any time. All fees are non-refundable except where required by law or at our sole discretion.

We reserve the right to change pricing with reasonable notice. Continued use after a price change constitutes acceptance.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • The quality, accuracy, or suitability of generated content
  • That the Service will meet your specific requirements
  • That generated content will be free from errors or artifacts

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Red Road Studio and its operators from any claims arising from your use of the Service or violation of these terms.

12. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time.

13. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance.

14. Export Controls and Sanctions

The Service is operated from the United States and is subject to U.S. export control and economic sanctions laws. By using the Service, you represent and warrant that you are not located in, under the control of, or a national or resident of any country or territory subject to comprehensive U.S. sanctions (for example, those administered by the U.S. Office of Foreign Assets Control), and that you are not on any U.S. government list of prohibited or restricted parties. You agree not to use the Service in violation of any applicable export control or sanctions law, and not to use generated output for any purpose prohibited by such laws.

15. Communications and Marketing

We will send you transactional and service messages related to your account (for example, security notices, receipts, and important changes to the Service); these are not optional while you hold an account. Marketing and promotional emails are separate and are sent only if you have given your explicit, opt-in consent. You may withdraw that consent at any time using the unsubscribe link in any marketing email or through your account settings, without affecting your ability to use the Service.

16. Governing Law

These terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Nothing in these terms limits any mandatory consumer-protection or data-protection rights you may have under the laws of your country of residence.
